Thus far into the endeavor, many inconsistencies have already been spotted within and between testimonies given by Mr. Jackson's accuser, the boy's siblings, and their mother. Timelines are sketchy, prosecutor questions are leading, and witness responses are at times uncertain, incoherent, and implausible. As one staff member put it, this collectively amounts to a "canyon of reasonable doubt."
Here is a brief examination of testimony given by the accuser's brother in front of a Santa Barbara grand jury on March 29, 2004. He shall be referred to as "James Doe." As you may already know, the 14-year old is said to be the sole witness to at least two acts of molestation Mr. Jackson is alleged to have committed against the boy's older brother "John."
During the boy's appearance in front of the grand jury, he alleged a series of occurrences that supposedly transpired between himself, his brother, and siblings of Frank Tyson, one of the unindicted participants of a purported conspiracy against the accusing family. James' most compelling testimony comes when he relayed what he claims he witnessed Mr. Jackson doing to the boy's brother.
When asked by Santa Barbara District Attorney Thomas Sneddon about when he stopped sleeping in Mr. Jackson's bedroom, James breaks into long narrative, with almost all of the divulged information not even instigated by further questioning. James said that as he was approaching the bedroom door, an alarm went off and that the door was "barely locked." He made his way into the bedroom and found his brother asleep with Mr. Jackson touching him. James described the positions of both his brother and the singer in bed, and added that there had been vodka and two glasses on a night table. Additionally, he stated that the only lights on in the room were the ones for the stairway that lead up to the second floor. It was from this stairway that James claims he witnessed it all not once, but twice.
Since the onset of this case, we have repeatedly heard from certain figures from the 1993 period, who have told the public that the pop star had these alarms specifically to alert him as to when people are approaching his room, so he would stop his illicit touching of boys. If that theory is to be believed, how then can anyone explain James' ability to make his way past this system and into the room without alerting Mr. Jackson? According to the boy's testimony, the alarm cannot be heard when the door leading upstairs to the bedroom is closed. So what exactly is the point of the alarm system if Mr. Jackson cannot hear it when the door is closed?
In concluding his testimony for the day, James was asked a number of questions, which in turn received bizarre responses. When asked by District Attorney Sneddon if he thought Mr. Jackson could see him from where he stood at the stairway, James said, "No, because it was below the bed."
Below the bed?
The boy added that though he was "below the bed," he could "still see" what was going on, but that Mr. Jackson could not see him. James also stated that he watched the first act of molestation for "probably five seconds, six seconds" and the second act for "three, four seconds."
This, together with the lack of illumination in the room, has left many perplexed. How was it that the boy was able to witness all that he claimed to have seen within those few short seconds, without any lights on in the room, and while he was "below the bed"?
Amazingly, not one question came from the grand jury. The 19-membered panel was probably as confused as those reading the testimony, which, no thanks to the prosecutor, jumped all over the place with regard to incidents and the time period during which they took place.
